What You Should Know About The K3 Marriage Visa

WHAT IS A K 3 VISA?
A K-3 Visa permits the spouse entry into the United States to await the I-130 petition approval from the USCIS or an immigrant visa if available.

Under a recent non-immigrant visa categorization, spouses of U.S. citizens may be granted the status of K-3 non-immigrant, and if the spouse has unmarried children (who have not reached 21 years old) may be given K-4 non-immigrant status. However, securing a K-3 or K-4 visa is not necessary. The wife or husband of a U.S. citizen and their children can forego the application process for a K3 visa and get their immigrant visa overseas straight from the DOS.

WHO IS ELIGIBLE TO APPLY FOR A K3 SPOUSAL VISA?

  • The people eligible to apply for a K3 Visa are "USA born citizens" Basically, you are legally married to foreign born person in a foreign country.
  • If you or your spouse were married before, you need to provide evidence that all prior divorces are fully completed 
  •  Your spouse needs to also be admissible to the following examples of these disqualifications are:  (if any of the apply below, grounds of admissibility are in jeopardy, it is recommended that you contact an immigration attorney) 

    • involved in prostitution,
    • submission of fraudulent paperwork and forms,
    • attempted to overthrow a government,
    • has medical condition of HIV/AIDS,
    • violation of their visa by overstaying
    • married to more than one person simultaneously

The K3 Visa was created by the U.S. to faciliate a way to allow spouses to enter the U.S. while they waited for the US Citizen's Petition to be approved. This type of visa allows the holder to travel to the United States and then become a legal permanent resident via adjustment of status. The K3 visa, differs from the k1 visa, in that it features a 2-year multiple re-entry into the U.S.; K-4 visas are classified for the children of K-3 applicants.
